Hemp beverage legality news out of South Carolina (opinion in comments)

South Carolina solicitor general issued an opinion to the Speaker of the South Carolina House of Representatives today addressing the legality of distribution, sale, and marketing of non-alcoholic beverages containing hemp-derived delta-9 THC below 0.3%

The opinion analyzes federal and state and reviews relevant case law to conclude “yes” the products are lawful if certain elements are met

The opinion highlights the legislature may want to revisit the “Hemp Farming Act of 2019” in order “to address the various issues surrounding the regulation of hemp-infused drinks and food products”
