The United States Court of Appeals for the Ninth Circuit has denied Central Coast Agriculture’s petition for a rehearing by the full court, meaning the case will not be reviewed by an 11-judge panel, but rather stands with the decision of the original three-judge panel.
This decision underscores the strength of BBK’s legal arguments and the validity of the initial ruling by the Ninth Circuit that, among other things, rejected the suggestion that BBK’s RAW® rolling papers are “drug paraphernalia” and reaffirmed the trial court’s decision that BBK’s RAW® rolling papers and other RAW® smoking products are not prohibited by the Controlled Substances Act. The Ninth Circuit’s denial means that the lower court’s decision in favor of BBK remains intact, thus preserving a crucial win for the company.
