Minnesota recently enacted a first-in-the-nation statewide ban on smoking and vaping cannabis in multifamily properties, including in individual living units.
The restriction, which went into effect this summer, does not apply to approved medical use.

The law has an exemption for those using marijuana for medical purposes. Violators of the law are subject to a civil administrative fine of up to $250. The medical exemption does not apply to federally funded housing because marijuana use and possession is illegal according to federal law.
Tobacco cigarette smoking is still permitted by the state in private units, although many multifamily properties have decided to go smoke-free on their own. Twelve states, including Minnesota, have laws prohibiting smoking of any kind in the public areas of private housing communities, but no states ban smoking in private units.
Eighty-five municipalities—all in California—have banned smoking in multifamily units.
