A Las Cruces cannabis company filed a civil lawsuit against the city and its administrators saying it blundered the enforcement of codes causing it to lose business.
Monster House Smoke LLC filed the suit July 6 in 3rd Judicial District Court. The filing lists the company, a dispensary and lounge business and husband and wife entrepreneurs Marc Splawn and Maggie Marble as plaintiffs.
Named as defendants were the city of Las Cruces, former City Manager Ifo Pili, city code inspectors Ismael Molina, Michael Landavazo and Cory Wieland, fire inspector Michael Danner and building inspector Cesar Granado.
Monster House Smoke LLC operates Monster House Dispensary and Lounge at 1275 W. Picacho Ave. in Las Cruces and two other locations in Las Cruces and one in Ruidoso. In its suit, Monster House said it was illegally ordered in 2023 to close its drive thru and in 2024 the city wrongly red tagged its lounge.
On Aug. 10 court records show that Luis Robles of the law firm of Robles, Rael and Anaya P.C. would defend the city and its administers in the suit. The Las Cruces Sun-News reached out to Robles but did not immediately get a response to a request for comment.
